Saudi Clerics Call For Adult Breast-Feeding

In a surprising development, two senior Saudi clerics today said that Saudi Arabia’s women should give their breast milk to male colleagues and acquaintances in order to safeguard the Islamic law that forbids mixing between the sexes. The clerics, however, failed to reach an agreement among each other on how the milk should be conveyed.

Recently a fatwa had been issued in the country about adult breast-feeding to establish "maternal relations" and preclude the possibility of sexual contact. The fatwa has already generated enough debates and it is likely that the debate over such explicit topics may force the Saudi government to introduce stricter regulations about how and when fatwas should be issued.

Sheikh Al Obeikan, an adviser to the royal court and consultant to the Ministry of Justice, had recently said that women who come into regular contact with men, who are not their relatives, should give them their breast milk in order to make them their relatives.

"The man should take the milk, but not directly from the breast of the woman. He should drink it and then becomes a relative of the family, a fact that allows him to come in contact with the women without breaking Islam's rules about mixing," Al Obeikan said, according to Gulf News. "

Obeikan’s remarks were followed by an announcement by another powerful Saudi cleric Abi Ishaq Al Huwaini, who asked women to allow the men to suckle the milk directly from their breast.

dalam perbincangan bab muharramat kelas ketiga iaitu disebabkan susuan. pengharamannya pada pernikahan dan aurat sama dengan pengharaman atas sebab kerabat terdekat dan musaharah (melalui jalan perkahwinan). pengharaman itu berasaskan dalil dari surah an-Nisa ayat 23 juga sabda ar-rasul s.a.w ((diharamkan drpd ar-radha'ah itu (susuan) apa yang diharamkan drpd nasab dan musaharah)) au kama qaal ar-rasul s.a.w

kemudian ulama' bahaskan pula kadar penyusuan:

ulama' hanafi dan maliki berpendapat cukup hanya sekali susuan untuk mengharamkan (menjadikan seseorg itu haram bernikah* dgn saudara susuannya). sedikit atau banyaknya susuan itu dikira sama, sebab dari nas yang disebutkan di atas tak dikhususkan kuantiti.

ia juga menurut pandangan ali abi talib, ibnu 'abbas dan ibn mas'ud

menurut as-syafi'iyah dan al-hanabilah: tidak ditetapkan pengharaman (yakni pd perkahwinan dan yg berkaitan) melainkan dgn lima kali susuan (5x kenyang + tak makan makanan lain selain susuan tersebut).

menurut Syi'ah Ja3fariyah: syarat bagi pengharaman susuan 15 kali susuan penuh iaitu susuan siang dan malam dengan jarak antara kedua2 waktu tersebut. kerana 'illah pengharaman susuan ini menjadikan susu itu darah daging. menurut sayidah a'isyah Radhiyallahu 'anha, pengharaman tak dikira melainkan jika bdk tersebut disusukn sehari penuh (tempoh paling kurang). - lihat kitab al-mughniy.

mazhab Zahiri terdapat dua riwayat:

  1. dr Daud az-Zahiri: pengharaman tidak ditetapkan melainkan dgn tiga kali susuan (ini juga riwayat dlm mazhab Hanbali)
  2. dr Ibn Hazm: harus 5x kenyang susuan semata2.

tempoh susuan (mahram)

fuqaha' (hanabilah, malikiyah, syafi'eyah atau abu yusuf dan muhammad dr hanafiyyah) bersetuju bahawa tempoh bagi susuan mahram iaitu dua tahun pertama umur kanak-kanak.

pendapat abu Hanifah bahawa tempoh susuan selama 30 bulan.
pendapat az-Zahiri: tiada tempoh tertentu bagi susuan walaupun pemuda menyusu seorang perempuan maka dia menjadi anak susuan wanita tersebut.

adapun apabila seseorang budak sebelum berumur dua tahun berhenti menyusu ibunya, kemudian disusukan pula oleh perempuan lain selepas itu maka tidak disabitkan hurmahnya(pengharaman spt di atas) - ini pandangan mazhab maliki. pada kes yg sama spt td tetapi disabitkan 'hurmah'nya menurut pandangan abu hanifah & as-syafi'e.
